Terms of use
Version of 27 October 2026. These terms cover the Cá Perto app and the site caperto.pt.
1. Who provides the service
Cá Perto shows deals from nearby shops in Portugal and lets a person reserve an item to collect in the shop. Payment happens in the shop, not in the app. We never ask for card details.
The controller of personal data is the operator of Cá Perto, reachable at solivagames@gmail.com. The legal name, the Portuguese company number and the registered address will appear in this paragraph before the app is published in the stores.
A reservation is not a distance purchase. When a sale happens, the contract is between the customer and the shop. Cá Perto organises discovery of the deal and the reservation of stock.
2. Account
An account asks for a name, an email, a password and an area. The password is stored only as an irreversible hash. The account is for people aged 16 or over. A person who posts for a shop confirms they can bind that shop.
The person keeps the password confidential. They can reset it with a six-digit code sent to the account email. The code lasts 15 minutes and stops working after five failed attempts. Changing the password ends earlier sessions.
3. An area, not a trail
The account stores the name of the chosen area and the furthest distance at which the person wants to see deals. If the phone allows location, we use it once to suggest that area. We do not store the route, and we do not store the phone's coordinate on the account. Coordinates, when they exist, are the shop's, for the address and the distance.
4. Reservation
Reserving holds one unit for the time shown in the app. Cancelling within that time returns the unit to the shop. After the time, the reservation is no longer active. The deal price and the quantity are what the shop published. The shop may sell out or close. Cá Perto does not promise the item will be at the counter if the shop has withdrawn it.
5. Photographs that may be published
The photograph is of the item on offer, taken by the merchant or used with the right to do so. It shows the product. It may show the counter or the shop front if the item stays recognisable. The app sends a JPEG.
A profile photo is of the account holder and may show their face. A shop photo is of the front, the window or the inside. Both follow the same JPEG format, the same size limits and the same check before they are stored. They may not show nudity, violence, documents, or someone else's face without permission. They are deleted with the account or the shop.
A photograph may not be published if it is, or appears to be:
- nudity, a sexual act, or a sexual image, including suggestive content;
- violence, blood, cruelty or a threat;
- the identifiable face or body of a customer, a child, or any person who has not allowed the use of their image;
- an identity document, a card, a screen or a paper carrying someone else's personal data;
- a different product, used to suggest the deal is for something else;
- an image the merchant does not own: stock photography, another listing, someone else's brand, or a picture copied from the internet;
- goods whose sale is illegal.
Before it is stored, the photograph is sent to Google Cloud Vision (SafeSearch) for classification. If the result is likely or very likely for adult, violent or suggestive content, the photograph does not enter the listing, the storage or the database. An unreadable file does not enter either. If the check is unavailable, publishing waits: without the check, the photograph is not stored.
Automatic classification can fail in both directions. Cá Perto may refuse or remove a photograph later. There is no approval queue for photographs that pass this check. The merchant can send another picture of the product.
By publishing, the merchant warrants they have the right to use the image and allows Cá Perto to show it in the app, on the site and in notifications for that deal, for as long as the listing exists. Ownership does not pass to us. When the listing or the shop account is deleted, the photograph is deleted with it.
6. The shop
The merchant posts true information: shop name, address, category, hours, text and price. The deal price must be lower than the original price. Do not post an item you do not have. Cá Perto may remove a listing that breaks these terms or the law.
7. Personal data and how we update it
We process personal data under Regulation (EU) 2016/679 (GDPR) and Portuguese Law 58/2019. What we store is also described in the privacy policy.
The person corrects their own data in the app, and the change is stored at once:
- name;
- area and maximum distance;
- favourite categories;
- account notifications, on or off;
- shop details, for a merchant: name, address, category, hours, text, shop photo and coordinates;
- a profile photo, which the person can add or remove;
- email, inside the app, after confirming the current password;
- password, inside the app with the current password, or with the code sent by email when the person cannot sign in.
Someone who cannot sign in asks to correct the email at solivagames@gmail.com, from the registered email or by a means that lets us confirm it is them. We do not change an account on a third party's request.
Besides correcting data in the app, the person may ask, at the same address:
- for access to the data we hold about them;
- for rectification of anything inaccurate that the app cannot change;
- for erasure;
- for restriction of processing, while a rectification or an objection is checked;
- for portability, in a structured, machine-readable format;
- to object to processing based on legitimate interest.
We reply within one month. If the request is complex or repeated, the period may extend by two further months, and we say why within the first month. If we cannot confirm identity, we ask for what is missing before we disclose or change data. Deleting the account is done in Profile, inside the app: the account, favourites, notifications and reservations go (active ones are cancelled and the unit returns to the shop), and so do the shop, the listings and the photographs. Backups, if any, are not used to restore that account and disappear on the normal backup cycle.
In-app notifications rest on the person's choice, which they can turn off in settings. The password-code email is necessary for the account and is not advertising.
Grounds for processing:
- performance of the service asked for: account, reservation, publishing the deal;
- consent: notifications, and the camera and location permissions the phone system controls;
- legitimate interest: account security, abuse prevention, and checking the photograph before it is published.
We share only what the service needs with those who provide it: hosting of the database and the photographs, sending the code email, and Google, only to classify the photograph at the moment of publishing. We do not sell data. We do not build advertising profiles. There is no ad tracking.
We keep the data while the account exists and, for the password code, for its 15-minute life. A person may lodge a complaint with the Portuguese Data Protection Authority (CNPD).
8. Acceptable use
Do not use someone else's account, do not bypass the photograph check, and do not overload the service. We may suspend an account that breaks these terms or the law, after notice when notice would not undermine security or another person's rights.
9. Changes
When these terms change in a material way, the date at the top changes and, if the person has an account, we say so in the app or by email before the new version applies. Continuing to use the service after that date accepts the new version. Anyone who disagrees can delete the account.
10. Law
Portuguese law applies. For a consumer dispute, the person may use the competent consumer alternative-dispute body in Portugal. Nothing in these terms removes mandatory consumer rights.
